Inhouse Orders — Terms of Service
Effective Date: October 9, 2026 Last Updated: October 9, 2026
1. Introduction
These Terms of Service (the "Terms") govern your access to and use of the Inhouse Orders platform, including our marketing website (inhouse-orders.com), restaurant ordering websites, reservation and waitlist pages, restaurant operator dashboard and client portal, point-of-sale ("POS") application and devices, printing services, and related APIs (collectively, the "Service"), operated by Inhouse 2, LLC ("Inhouse Orders," "we," "us," or "our").
By creating an account, placing an order, making a reservation, joining a waitlist, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Definitions
- "Restaurant" means a food-and-beverage business that subscribes to the Service to accept orders, manage reservations and waitlists, process payments, and operate its point of sale.
- "Restaurant Personnel" means individuals authorized by a Restaurant to use the Service on its behalf (owners, managers, staff, servers, cashiers).
- "Diner" means an end customer who places an order, makes a reservation, joins a waitlist, or otherwise interacts with a Restaurant through the Service.
- "Customer Data" means data that Diners provide to a Restaurant through the Service, including names, contact information, order history, reservation and waitlist details, and payment details.
- "Restaurant Content" means menu items, descriptions, prices, images, branding, hours, policies, and other content uploaded by or for a Restaurant.
3. Eligibility and Accounts
3.1 Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account or pay through the Service. The Service is offered in the United States; we make no representation that it is appropriate or available elsewhere.
3.2 Account Security
Restaurants and Restaurant Personnel must register with accurate information. You are responsible for keeping your credentials confidential — including staff PINs, which should be unique to each person and never shared — and for all activity under your account. Notify us immediately at contact@inhouse-orders.com if you suspect unauthorized access.
3.3 Roles
The Service supports roles such as owner, manager, server, and cashier. The Restaurant is responsible for assigning roles appropriately, protecting POS devices from unauthorized use, and removing access promptly when Restaurant Personnel leave.
4. Restaurant Terms
4.1 Plans, Fees, and Billing
Restaurants subscribe on a month-to-month basis unless an order form says otherwise, and may cancel as described in Section 13. Fees are those stated in the Restaurant's order form or published pricing in effect when the Restaurant signs up, and may include a monthly subscription per POS station, a fee per online order, hardware, setup, and pass-through charges (for example, delivery fees). We may change our fees with at least 30 days' notice; changes apply from the next billing period. Fees are non-refundable except as required by law or stated in an order form. Failure to pay may result in suspension or termination of the Service.
4.2 Hardware
Hardware a Restaurant buys from us (such as POS stations, payment terminals, customer displays, and printers) belongs to the Restaurant once paid for. Hardware is covered only by the manufacturer's warranty, if any, which we will help the Restaurant use; we otherwise provide hardware "as is." Payment terminals must stay registered with our payment processor to accept cards through the Service. The Restaurant is responsible for hardware it buys from others and for keeping devices physically secure.
4.3 Restaurant Responsibilities
Each Restaurant is responsible for:
- The accuracy of its menus, prices, fees, hours, allergen information, and other Restaurant Content, including content generated with AI features
- Honoring orders, reservations, and waitlist entries placed through the Service
- Its own reservation, deposit, cancellation, no-show, and refund policies, and for applying them fairly and lawfully (including any decision to decline future bookings from a Diner)
- Complying with food-safety, labeling, alcohol, tax, consumer-protection, employment, wage-and-hour, and tip laws that apply to its business, including how tips are collected, recorded, and paid out to employees
- Obtaining a Diner's consent before Restaurant Personnel enter the Diner's phone number to send text messages (for example, to add them to the waitlist or send a payment link), and accurately recording that consent in the Service
- Giving its staff any notice required by law that the Service records their time-clock entries, POS actions, and (if used) voice commands
- Treating Customer Data in line with these Terms, our Privacy Policy, and applicable privacy law (as between the Restaurant and Inhouse Orders, the Restaurant controls its Customer Data and we process it on the Restaurant's behalf)
- Resolving Diner complaints, disputes, and refund requests for its orders, reservations, and waitlist
4.4 Card Processing, Surcharges, and Cash Discounts
Card payments are processed by Finix Payments, Inc. ("Finix") and its partner banks. To accept cards, the Restaurant must complete Finix's onboarding and agree to Finix's merchant terms, which govern settlement, funding schedules, reserves, holds, chargebacks, and account closure. Inhouse Orders is not a bank or money transmitter and does not hold Restaurant funds.
If a Restaurant uses a card surcharge, cash-discount, or dual-pricing program (for example, a "Card Processing Fee" added to card payments, or a "wholesale" interchange-plus rate), the Restaurant is solely responsible for making that program lawful where it operates, including any state-law limits or prohibitions, card-network rules (such as caps, required notice at the entrance and point of sale, receipt display, registration, and restrictions on surcharging debit and prepaid cards), and clear disclosure to Diners before payment. The Service provides configuration tools; it does not provide legal advice, and Inhouse Orders is not responsible for a Restaurant's choice to use these programs.
4.5 Permitted Use of Customer Data
Restaurants may use Customer Data only to operate their business — fulfilling orders, managing reservations and waitlists, communicating with Diners about their transactions, and (only with the consent required by law) sending marketing messages that comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, carrier messaging rules, and state privacy laws. Restaurants must not sell Customer Data, share it with unrelated third parties, or use it in violation of these Terms.
4.6 Restaurant Content License
Restaurants grant Inhouse Orders a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting and display), display, and transmit Restaurant Content as needed to operate and promote the Service, including showing the Restaurant's name and logo as a customer of Inhouse Orders unless the Restaurant asks us not to. Restaurants represent that they have the rights to the Restaurant Content they provide.
4.7 Google Business Profiles and Online Listings
If a Restaurant asks us to set up or manage its Google Business Profile or other online listings, we act on the Restaurant's instructions, and the Restaurant remains the owner of those listings and their content. The Restaurant may ask us to transfer or remove our access at any time.
5. Diner Terms
5.1 Orders
When you place an order, you make an offer to buy the listed items at the listed prices from the Restaurant. The Restaurant — not Inhouse Orders — is the seller of food and beverages and is responsible for preparing them. An order is accepted when the Restaurant confirms it. Ready times and delivery times are estimates.
5.2 Reservations and Waitlists
You may use the Service to reserve a table or join a waitlist at a participating Restaurant. Reservations and waitlist entries are subject to the Restaurant's policies, including any cancellation or no-show policy shown when you book. Waitlist positions and wait times are estimates; the Restaurant decides seating order and may remove you from the waitlist if you are not present when your table is ready. A Restaurant may decline future bookings from guests who repeatedly do not show up or who violate its policies. If a Restaurant requires a deposit or no-show fee, it will be disclosed before you book, and you authorize the charge you agree to at booking.
5.3 Prices, Fees, Taxes, and Tips
Prices, taxes, fees, and tips are shown before you pay. Prices and availability are set by the Restaurant and may change without notice. Fees may include a convenience or online-ordering fee, a delivery fee, other fees set by the Restaurant, and, for card payments at some Restaurants, a card processing fee or a higher card price (cash discount). Each fee is shown before you complete payment. Tips are optional unless the Restaurant discloses a required service charge.
5.4 Delivery
Delivery orders are carried by independent third-party couriers (currently DoorDash). We share your name, phone number, email, address, and delivery instructions with the courier to complete your delivery, and the courier may contact you about it. Neither Inhouse Orders nor the Restaurant controls the courier, and delivery times are estimates.
5.5 Saved Payment Methods
If you choose to save a card, you authorize the Restaurant and Finix to store it and to charge it for future orders you place. You can ask us to remove a saved card at any time.
5.6 Cancellations and Refunds
Cancellation and refund policies are set by the Restaurant. Inhouse Orders is not the seller and does not issue refunds on behalf of Restaurants except as the Restaurant instructs or the law requires.
5.7 Allergies and Dietary Needs
Allergen and ingredient information is provided by the Restaurant. Always confirm allergies and dietary needs directly with the Restaurant. Inhouse Orders does not prepare food and cannot guarantee that any item is free of allergens.
6. Payment Processing
6.1 Payment Processor
Payments are processed by Finix or another third-party processor. By giving payment information, you authorize the charges you approve at checkout, at the payment terminal, or by payment link, including any tip, and any tip adjustment you write on a receipt.
6.2 No Storage of Card Numbers
Inhouse Orders does not store full card numbers or security codes. Card data is tokenized and held by the payment processor in a PCI DSS–compliant environment. Some terminals capture your signature, which is stored with the transaction record.
6.3 Disputes and Chargebacks
Please contact the Restaurant first about any charge you don't recognize or disagree with. Restaurants are responsible for chargebacks, refunds, and related fees on their transactions as set out in their merchant terms.
7. Text Messages and Email
7.1 Transactional Text Messages
By providing your phone number for an order, reservation, waitlist entry, payment link, or verification, you agree to receive text messages from Inhouse Orders on behalf of the Restaurant about that transaction — for example confirmations, status updates, delivery tracking, payment links, reminders, table-ready alerts, cancellations, and verification codes. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.
7.2 Replies, STOP, and HELP
You may reply to certain messages (for example "C" to confirm or "X" to cancel a reservation, or "OMW" when you are on your way). Reply STOP to stop text messages from that number, or HELP for help. After you opt out, you may not receive reminders or table-ready alerts by text.
7.3 Marketing Messages
Marketing text messages are sent only with your separate, express written consent. Unsubscribe from marketing email using the link in the message.
7.4 Providers and Carriers
Text messages are delivered by Twilio and email by Postmark or other providers. Carriers and Inhouse Orders are not liable for delayed or undelivered messages or for charges from your wireless carrier.
8. Acceptable Use
You agree not to:
- Use the Service to violate any law or third-party right
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Interfere with the Service (including denial-of-service activity, scraping, automated bookings or orders, or probing for vulnerabilities outside an authorized program)
- Reverse-engineer, decompile, or extract the source code of the Service, except where the law allows
- Submit content that is illegal, infringing, defamatory, harassing, or harmful
- Make bookings or orders you do not intend to keep, or use false contact details
- Send spam or messages that violate the TCPA, CAN-SPAM, carrier rules, or other anti-spam laws
- Misrepresent your identity, affiliation, or the products you offer
- Process payments for goods or services prohibited by Finix or card-network rules
We may suspend or terminate access for any violation, with or without notice.
9. AI Features
Some optional features use artificial intelligence (for example, the POS voice assistant and menu image generation). AI output can be wrong or unexpected. Restaurant Personnel must review AI output — including orders created by voice and generated menu images — before relying on it or showing it to Diners, and the Restaurant is responsible for what it publishes. Do not use AI features to enter payment card numbers or other sensitive information.
10. Intellectual Property
10.1 Our IP
The Service — including software, design, branding, trademarks, and documentation — is owned by Inhouse Orders or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
10.2 Feedback
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
11. Third-Party Services
The Service relies on and integrates with third parties, including:
- Google (Firebase hosting, sign-in, database and analytics; Google Maps; reCAPTCHA; Gemini AI)
- Finix Payments (payment processing and merchant onboarding)
- Twilio (text messages) and Postmark (email)
- Microsoft Clarity (website analytics and session recording)
- OpenAI (optional AI features)
- DoorDash (delivery) and Uber Eats (marketplace orders, for Restaurants that use it)
- Star Micronics CloudPRNT, Sunmi, and PAX (printing, POS, and payment hardware)
- Hosting and infrastructure providers such as Railway, Heroku, Cloudflare, Cloudinary, and Capgo
Your use of those services may be subject to their own terms and privacy policies. We are not responsible for their availability, accuracy, or actions. Features that depend on a third party (for example, a delivery or marketplace integration) are available only while that third party supports them.
12. Service Availability and Changes
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, internet or power outages at the Restaurant, third-party outages (including Google, Finix, Twilio, and DoorDash), and events beyond our reasonable control may interrupt the Service. Restaurants should keep a backup way to take orders and payments. We may modify, add, or remove features; features labeled beta or pilot are provided as-is and may change or end.
13. Termination
13.1 By You
Restaurants may cancel at any time with notice to contact@inhouse-orders.com; cancellation takes effect at the end of the current billing period unless an order form says otherwise. Diners may ask us to close their accounts at any time by contacting contact@inhouse-orders.com.
13.2 By Us
We may suspend or terminate access, with or without notice, for breach of these Terms, non-payment, suspected fraud, a termination or suspension by our payment processor, or to protect the Service or other users. Where practical, we will give a Restaurant notice and a chance to fix the issue first.
13.3 Effect of Termination
On termination, your right to use the Service ends. For 30 days after a Restaurant's subscription ends, the Restaurant may request an export of its menus and order history; after that we may delete or de-identify its data, subject to our legal retention obligations. Sections that by their nature should survive (including fees owed, IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
14. Disclaimers
THE SERVICE AND ANY HARDWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
INHOUSE ORDERS IS A TECHNOLOGY PROVIDER. WE DO NOT PREPARE, SELL, OR DELIVER FOOD, OPERATE A RESTAURANT, OR HANDLE FOOD-SAFETY OR ALCOHOL COMPLIANCE. WE DO NOT WARRANT THE QUALITY, SAFETY, ALLERGEN CONTENT, OR LEGALITY OF ITEMS PURCHASED THROUGH THE SERVICE, OR THE ACTS OF RESTAURANTS OR DELIVERY COURIERS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INHOUSE ORDERS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, SALES, DATA, OR GOODWILL (INCLUDING LOSSES FROM SERVICE OUTAGES, MISSED ORDERS, OR PAYMENT PROCESSOR HOLDS), ARISING OUT OF OR RELATED TO THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO INHOUSE ORDERS IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100). AMOUNTS YOU PAY TO A RESTAURANT FOR FOOD AND BEVERAGES ARE NOT AMOUNTS PAID TO INHOUSE ORDERS.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS ABOVE; IN THOSE JURISDICTIONS THE LIMITATIONS APPLY TO THE GREATEST EXTENT PERMITTED BY LAW.
16. Indemnification
You agree to indemnify, defend, and hold harmless Inhouse Orders and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your content, (c) your violation of these Terms, or (d) your violation of any law or third-party right. Restaurants additionally indemnify Inhouse Orders for claims arising out of the Restaurant's food and services, its handling of Customer Data, its messages to Diners, its surcharge or cash-discount program, its tip and wage practices, and its Restaurant Content.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Denver County, Colorado, and you and Inhouse Orders consent to personal jurisdiction there. Before filing a claim, you agree to contact us at contact@inhouse-orders.com and try in good faith to resolve the dispute informally for 30 days. Any claim must be brought within one (1) year after it arises, to the extent the law allows.
18. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new Effective Date, and for material changes we will give Restaurants notice by email or in the Service. Continued use after the change becomes effective means you accept the updated Terms.
19. General
- Entire Agreement: These Terms (together with any order form and the Privacy Policy) are the entire agreement between you and Inhouse Orders about the Service. If an order form conflicts with these Terms, the order form controls for that Restaurant.
- Severability: If any provision is unenforceable, the rest remain in effect.
- No Waiver: Not enforcing a provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not responsible for delays or failures caused by events beyond our reasonable control.
- Electronic Communications: You agree that notices, agreements, and other communications we send electronically satisfy any requirement that they be in writing.
- No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
